Terms and Conditions

The FH Business App are governed by the following FH Business App Terms and Conditions (“Terms and Conditions”). Other T&Cs governing the Customer's account (General T&Cs relating to accounts and FH digital services) with FH will continue to be applicable except only where such other T&Cs are in conflict with these Terms and Conditions, in such case these Terms and Conditions shall prevail. By applying for and using the FH Business App , the Customer acknowledges and accepts these Terms and Conditions and any supplementary T&Cs that may from time to time be in force.

  1. Definitions:

Account(s) means any of the account(s) maintained by the Customer or any new accounts(s) which may be opened from time to time with FH, and which is/are accessed by means of the Services.

AED means the lawful currency of the UAE.

Authentication Procedure means FH’s procedure, that might change from time to time, relating to the verification of the identity of persons using or having access to the Services through the Access Procedure and carrying out or authorizing any transactions in respect of Account(s).

Authorized Signatories means person(s) who are appointed by the Customer and are able to appoint Users in respect of the Services.

Business Day means any day, excluding Friday, Saturday and declared public holidays, on which FHs in U.A.E. are normally open for conducting business.

Business Hours means the hours of any Business Day during which FHs are generally open for business.

Central Bank means the Central Bank of the UAE.

FH Business App means electronic platform which enables the Customer to conduct Transactions and Instructions, enquire and download statements on the Account with FH via the internet.

Company ID means the unique identification number which identifies the Customer.

Customer means a legal entity holding the Account maintained with FH and which has entered into a contract with FH for the Services.

Deposit Account means a deposit product, which is specifically designed to grant businesses higher rates of return on their longer term deposits.

e-Signature means  e-signature, refers to data in electronic form, which is used by the signatory to sign.

Fixed Term Flexi Deposit means pays interest similar to a deposit account yet provides the flexibility to withdraw cash at short notice.

In-app Notifications means messages that are send to you in the FH Business App to help drive awareness, or help guide in performing a task more easier for a user.

Instruction means any communication, order, message, data, information sent by the Authorized Signatory or a User remotely and electronically to FH through the FH Business App.

FH PayDay WPS Services means the facility through which FH issues payroll cards to the Customer which allows the Customers employees to withdraw money from automated teller machines and make online purchases or purchases at any of the merchant outlets.

Fund Transfer means the functionality enabling the Customer to instruct FH to debit its account and to credit specific beneficiary.

FTS means the transfer of funds / salaries through the Funds Transfer System and the related rules as mandated by the Central Bank of the UAE.

Mandate means the Account operating Instructions, setting out the identity of the Authorized Signatories and User(s) authorized by the Customer to execute and authorize transactions and avail the Services applying to the Accounts on behalf of the Customer.

Mandate Change means a request for addition, deletion or substitution of any person designated as an Authorized Signatory or User(s) in the Services or any amendment, variation or revision of the scope, extent or limit of the authority conferred on any Authorized Signatory or User(s) by the Customer.

Payment means bill payments, Intra-bank payments from a Customer's account to another account within FH, domestic or international funds' transfer from a Customer's account to an account held with another bank.

Payment Cut-off Time means the cut-off times notified to the Customer by FH after which all local and international fund transfers will be processed the next Business Day and, if applicable, may also be a working day in the country of the final beneficiary.

Platform means the Corporate Banking Smartphone App or Internet Portal provided by FH.

Regulations mean any laws and regulations including international regulations as well as regulations of other countries which are applicable to the operation of FH.

RG means Rabeh Guarantees.

Services means the corporate electronic banking services that FH makes available through the Platform and facilities that use electronic equipment and include online banking and mobile banking to enable the electronic receipt, payments and transmission of information and Instructions.

Set-up Form means the set-up form (of which these Terms form a part), whereby the Authorized Signatory, on behalf of the Customer, may designate and nominate the authority and responsibility to the Users, defining their limits and authority levels to operate the Account(s) in accordance with the Mandate held with FH.

Transaction means any transaction or operation made or performed, processed or effected through the FH Business App by the Authorized Signatory or the User, acting on the Customers behalf.

UAE means United Arab Emirates.

UAE Pass means  the national digital identity for the UAE, where citizens, residents, and visitors. Can access services across different sectors in the UAE, as well as digitally sign documents.

User(s) means a person who can use the Services including a transaction maker, transaction authorizer and any person appointed as such at a subsequent date. Each User must have a unique user ID and Password to access the Services. Each User must be authorized by the Authorized Signatory(ies) and their ability to perform tasks and access Accounts is restricted by their User and Account permissions and ability to gain access to the Service via the Access Procedure. Users must comply with FH’s Authentication Procedures for the Services.

User ID means the Internet Banking Identification code (alphanumeric) assigned to User(s) by FH for the purposes of identification in respect of use of the Services by such person(s), including when logging on to use the Services via the Access Procedure.

WPS means the transfer of salaries through the UAE Wages Protection System and the related rules as mandated by the Central Bank of the UAE.

  1. Acceptance of the Terms

2.1 By registering on the FH Business App and/or by using the Services, the User shall be deemed to have understood and agreed to these Terms and Conditions and any other applicable T&Cs relating to the provision of the Services which are imposed by FH from time-to-time.

  1. Eligibility

3.1 Any Customer can apply for the FH Business App by completing the relevant application process through any one of the FH’s communication channels from time to time, which include, without limitation, the branch network, Relationship Managers, call centre, email, etc.

3.2 The FH Business App is only made available to a Customer who meets the criteria as determined by FH and as may be published on its website from time to time.

3.3 For security reasons and to ensure controlled and legitimate and lawful access to and use of the FH Business App, in particular the smartphone App, the Customer must have a mobile phone or other smart device whose number is duly registered with FH.

3.4 FH reserves the sole right to refuse to offer the FH Business App to any Customer for any reason at its absolute discretion and without giving any reasons for such refusal.

  1. Customer’s Consent

4.1 The Customer agrees that any use of Services provided by the FH Business App to the Customer establishes unequivocally the Customer’s consent to these Terms & Conditions.

  1. Availability

5.1 FH will, on a best effort basis, make available FH Business App. However, availability is also dependent on third party service providers (including telecommunications providers) and may be interrupted from time to time by routine maintenance requirements, excess demands on the platform and reasons beyond the control of FH, all or part of which may cause disruptions in the availability of the Service.

5.2 FH may, at any time, suspend the FH Business App or any Services available under it without any notice, where it is necessary or advisable to do so.

5.3 FH may, at any time, alter, amend or replace any procedure, platform or Service to maintain a particular level of encryption, security and confidentiality of the FH Business App.

5.4 FH shall inform the Customer of any prolonged inaccessibility to, or unforeseeable but necessary termination of the FH Business App.

5.5 FH may restrict or cease the Customer’s use of the FH Business App at any time and for any reason upon notice to the Customer.

5.6 In using the FH Business App, the Customer:

(a) must ensure that its/ computer, mobile phone or other smart device and any other related equipment used to access the FH Business App is compatible with the FH Business App and is free from any computer, mobile phone or other smart device viruses and must adequately protect such equipment by installing up-to-date security, anti-virus and other software;

(b) agrees that, if it accesses and uses the FH Business App through a computer, mobile phone or other smart device which it does not own or otherwise is not legally registered in its name, it does so entirely at his/her risk;

(c) agrees that the internet is not a completely reliable means of communication and he/she communicates through such means entirely at his/ her own risk;

(d) irrevocably and unconditionally accepts liability for any and all Instructions without limitation;

(e) must check regularly its statements of Account(s) and promptly notify FH of any discrepancy; and

(f) must not interfere with or damage (or in any way attempt to) any data, software or security associated with online banking.

5.7 FH may suspend any Service available on the FH Business App without prior notice where FH considers it necessary or advisable to do so.

  1. User ID, Password and Other Authentication Details Reset

6.1 The FH Business App may require a reset of the Customer’s User ID, password or other authentication factor at any time by FH notifying the Customer.

6.2 The FH Business App user may at any time change its/his/her User ID, password or other authentication factor as may be permitted within the functionality of the FH Business App or otherwise by contacting FH through any one of the channels from time to time.

  1. Instructions from Customer

7.1 Any instruction from the Customer which is either a request for information, a transaction instruction or another form of instruction (an "Instruction" and together "Instructions") shall, unless proven otherwise, be deemed to be validly, knowingly and genuinely sent by or on behalf of the Customer.

7.2 FH will be entitled to rely and act on Instructions without any further confirmation or verification from the Customer.

7.3 The Customer authorises FH to act on all Instructions from the Customer through the FH Business App and irrevocably and unconditionally accepts as binding all such Instructions.

7.4 Any transaction(s) initiated by the User(s) will be executed entirely as per the user permission flow mandate defined for the Service at the time of initiation.

7.5 In the case of a transaction Instruction, it is the Customer’s responsibility to ensure that all details relating to the intended beneficiary’s account are input correctly. FH is under no obligation to verify these details and cannot be held liable for any funds transferred to an incorrect beneficiary.

7.6 Once an instruction is submitted and authorised through the FH Business App, FH shall be under no obligation to accept any amendment or cancellation thereof.

7.7 Transactions will be processed only upon the availability of sufficient funds in the Customer's account at the time the Customer submits the Transaction.

7.8 The Customer accepts that FH may impose a daily transaction limit on a Transaction using the FH Business App.

7.9 Daily online limit(s) including the corporate, initiation and approval limit(s) are calculated as per the transactions executed by the User(s) on that day through the Platform.

7.10 Any transaction(s) initiated by the User(s) will be executed entirely as per the User permission flow mandate defined for the Service at the time of initiation.

7.11 Amendment / deletion of any beneficiary(s) details will not be reflected on any initiated transaction(s) / template(s) already setup including future dated transaction(s) / standing instruction(s).

  1. Timing for Processing of Instructions

8.1 From time to time, some Instructions may take time to process (for example, as a result of routine maintenance being carried out) and an Instruction may not be carried out simultaneously with an Instruction being issued by a User. If Users give the FH an Instruction:

(a) to make a payment from an Account on a Business Day but after the Payment Cut-off Time, it will be processed on the next Business Day;

(b) to make an AED transfer to any Account not held with FH either after the Payment Cut-off Time or on any day which is not a Business Day, it will not be made until the next Business Day; and

(c) to effect the transfer of a currency (other than AED) to an account with any other bank or financial institution after the Payment Cut-off Time, it will be made on the next day which is a Business Day in (i) the UAE, (ii) the country of the beneficiary’s account and (iii) the financial center for the relevant currency.

9.1 Instructions received from and appointments made by Authorized Signatories must comply with the Account’s operating instructions (including the Mandate) specifying the number of Users appointed in respect of the use of Services, the identity of the transaction authorizers and whether the Authorized Signatory/Signatories can set any financial limits on transactions carried out using the Services.

9.2 FH shall not have any obligation whatsoever to act upon and implement any Mandate Change:

  1. unless written notice of the Mandate Change has been given to FH in a form prescribed by or acceptable to FH and in accordance with FH’s operational procedures;
  2. unless and until FH is satisfied that the Mandate Change has been duly authorized by the Customer; and
  3. until, in the event that and after FH is satisfied that the Mandate Change has been duly authorized, such amount of time which FH would reasonably require (having regard to all the circumstances then prevailing) to enable FH to take the appropriate action to act upon and implement the Mandate Change shall have elapsed.

9.3 The Authorized Signatories shall notify FH, within three (3) Business Days of any resolution, amendment or document issued by the Customer which (i) authorizes any Authorized Signatories or User(s) to take any action or enter into any agreement on Customer’s behalf or (ii) confers any authority on any Authorized Signatories or User(s) to act on Customer’s behalf. FH shall be entitled to assume that such authority has been conferred on such Authorized Signatories or User(s) and has not been revoked by Customer until written notice of revocation is provided to FH.

9.4 Authorized Signatories will reflect the Mandate in the Customer Set-up Form for the authorization part of it. In case of any discrepancy in the details of the User(s) provided in the Mandate and in the Customer Set-up Form, the details provided in the Mandate will take precedence.

  1. Compliance

10.1 FH may be required, or may in its reasonable discretion consider it prudent, to take steps in relation to Transactions for the purposes of compliance with relevant laws and regulations including but not limited to the prevention of money laundering, terrorist financing and the provision of financial and other services to persons or entities which may be subject to sanctions. These compliance steps may include the interception and investigation of Transactions and making further enquiries as to whether or not a name which might refer to a sanctioned person or entity actually refers to that person or entity.

10.2 FH shall not be liable for any direct or indirect loss, liability or cost incurred by the Customer as a result of FH undertaking such compliance.

10.3 In case a compliance investigation is initiated on a specific Transaction, FH holds the sole power to accept / reject processing of such Transactions including actions not limited to reversing the debited funds back to Customer’s account, holding the available money in Customer’s account and the suspension of the overall Customer’s access to the FH Business App.

  1. Standing Instruction

11.1 If a standing Instruction / future dated Transaction is setup by the Customer using the FH Business App, the Transaction will automatically be processed by FH on the pre-defined execution date. A standing Instruction can be setup only for future dated Transactions and not for current dated Transactions.

11.2 The funds will continue to be debited from the Customer's account until the Customer may cancel the standing Instruction through the FH Business App at any time before the next payment date or submits a letter to a Bank branch to cancel the standing order Instruction regardless of the availability of the account(s) or the status of the User(s) in the Service.

The Customer is responsible to ensure that the account is funded at the time of execution of the standing Instruction to prevent Transaction being rejected by the system.

  1. In Platform – Notifications

Alerts and notification are available through the FH Business App. The Customer can setup and choose the types of Alerts and Notification or make changes to the choices through the FH Business App. FH at its own discretion might force showing an in-platform notification for the purpose of but not limited to displaying certain Transaction status to the Customer, advertise or market certain product / service / offering or provide a general update about any feature in the platform.

  1. Customer’s General Responsibilities

The Customer is responsible for:

13.1 maintaining and informing FH with the most updated list of Authorized Signatories and any prospective Mandate Change;

13.2. complying with the terms when operating Account(s), including, but not limited to, the Authentication Procedures and/or Mandate requirements;

13.3. the actions of all User(s) including limiting the use of and access to the Services to such User(s) and any security duties and/or obligations and general undertakings in respect of the use of the Services set out in these Terms;

13.4. the accuracy of all information transmitted to FH’s systems by User(s);

13.5. using the Services as per the directions of FH;

13.6. notifying FH in writing when any User(s) leave(s) employment or has their permission to use the Services revoked by the Customer, to ensure revocation of authority and updating of authentication procedures in respect of that User;

13.7. checking the Account records and statements carefully upon receipt;

13.8. checking and verifying whether the Transactions are taking place as requested with regards to the future dated Transactions and the recurring Transactions and inform FH immediately of any discrepancies;

13.9. monitoring the use of the Services devices and ensuring that no un-authorized person has access to or use of the Services devices;

13.10. ensuring that no modification is made to the Services devices without the prior written consent of FH; and

13.11. ensuring that only User(s) can use the Services devices and issue Instructions.

  1. Disclaimer

14.1 FH does not represent or warrant that the Services on FH Business App (a) will be available and meet the Customer’s requirements or that access will be uninterrupted, (b) that there will be no delays, failures, errors or omissions or loss in transmission of information, (c) that no viruses or other harmful components will be transmitted; or (d) that no damage will occur to the device on which the Services are accessed. Due to the open nature of the internet, FH cannot guarantee and nor does it warrant the complete security of online Transactions from hacking, unauthorized access, virus attacks and other deliberate attempts by third parties in breaching the latest security features which may have been implemented. Nevertheless, FH will take all reasonably practicable steps to ensure that online transactions are secure (including the installation of security features which are designed to keep all communications private and confidential).

14.2 Customer and User(s) acknowledge that FH employs high level of encryption, to protect online transactions and Accounts from unauthorized access, which may be illegal in jurisdictions outside the UAE. The Customer and the User(s) shall be responsible to ensure that User(s)’ ability to use the Services is permitted by local laws of the jurisdiction in which Services are used and FH shall not be liable for any loss suffered by the Customer or User as a result of not being able to use the Services in such jurisdictions.

14.3 FH makes no representations or warranties regarding the accuracy, functionality or performance of any third party software that may be used in connection with the FH Business App or any other application or platform and the provided therein.

14.4 The use of the Services on the FH Business App is at the Customer’s and User’s sole risk. Information and materials are provided on an “as is” and “as available” basis and FH does not warrant accuracy, adequacy or completeness of these information and materials and expressly disclaims liability for errors or omissions in such information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, fitness for a particular purpose and freedom from computer virus is given in conjunction with the information and materials.

14.5. Unless otherwise stated or agreed with the Customer, the information contained in the Services and on the FH Business App have been prepared in accordance with the regulations and laws of the UAE.

14.6. Customer should carefully check the Account records and statements when they are received. If Customer believes that there has been a mistake or an error in any transaction using the Service, Customer should notify FH immediately. FH’s records, unless proven to be wrong, will be considered as conclusive evidence of Customer’s dealings with FH in connection with the Services.

14.7. FH will not be liable to Customer or any other person for any loss whether direct, indirect, consequential, special or incidental including, without limitation, any loss of profit, business revenue, goodwill or anticipated savings or loss of data, arising from:

  1. i) FH acting or failing to act upon any Instructions received by User(s);
  2. ii) any error contained in the information input and transmitted to FH’s internal systems;

iii) accessing or use of the Services via the Authentication Procedure but, in a manner, or a purpose not authorized by User(s);

  1. iv) the failure of telecommunications systems and communications networks or any mechanical failures, power failures, malfunction, breakdown or inadequacy of equipment;
  2. v) an event or cause beyond the reasonable control of FH including but not limited to acts of God, power of failure or variation in the supply of power, machinery or systems or processing systems failure, strikes, riots, acts of war, lockouts or industrial disturbances, governmental action superimposed after the date of signing of the Customer Set-Up Form, or communication line failures;
  3. vi) any fraudulent activity or negligence by the Customer’s employees, agents or any third parties whether or not User(s);

vii) any delays in the transmission of data between the User(s) and any recipients of the information, whether caused by breakdown, viruses or a fault in User’s equipment or software programs installed on their equipment or FH’s systems;

viii) any consequences of any virus or other destructive features which may adversely affect User’s hardware, software or equipment;

  1. ix) the failure of a transaction;
  2. x) any other cause, except where it is because of gross negligence or willful default on the part of FH or breach of a condition or warranty implied by statute on contracts for the supply of goods and services and which cannot be excluded, modified or restricted. FH’s liability for breach of any such non-excludable rights is limited, at the option of FH, to the supply of the Services again, or to the payment of the cost of having the Services supplied again; or
  3. xi) the accessing or use of the FH Business App via the Authentication Procedure but, in a manner, or for a purpose not authorized by the FH or a User.

14.8. FH accepts no liability for any loss whatsoever or howsoever caused arising from any interruption of the Services or any technical problem which interrupts access to or results in delays, failure, errors, omissions or loss of any transmitted information.

14.9. Some of the Services require FH to receive process and report information involving Accounts and Transactions. FH will not be responsible for determining the accuracy, timeliness or completeness of any information that Customer, its agents or any third party provided to FH. FH will not have a duty to interpret the content of any data transmitted to it, except as provided in these Terms and Conditions. Unless otherwise agreed in writing, FH will not be required (by means of any security procedure or otherwise) to detect errors in the transmission or content of any information it receives from Customer or a third party.

  1. Indemnity

15.1 Without prejudice to any other right or remedy available to FH (whether under any provisions of these Terms or otherwise), Customer hereby agrees to indemnify and hold FH harmless from and against any and all loss suffered or incurred by FH as a result of any of the following:

  1. any failure of the Customer, Authorized Signatory and/or the User(s) to comply with these Terms and Conditions or the security tips provided herein;
  2. any act or default, negligence or fraud of User(s) in the operation and use of any Services;

iii. FH relying or acting on or carrying out any Instruction, in any manner permitted under these Terms and Conditions;

  1. any act, omission or thing done or caused to be done by FH in connection with these Terms or any Account through no willful default of FH including but not limited to the disclosure by any officer or employee of FH to any person of any information relating to any Account or Instruction whether inadvertent or otherwise;
  2. any virus, default, deficiency or malfunction in and or any breakdown, disruption or failure of any software or any telecommunications, computer or other electronic equipment, device or system owned, operated and/or maintained by or on behalf of FH due to or caused by Customer or any of the Users accessing and/ or utilizing the Services;
  3. any defect, deficiency or malfunction whatsoever or howsoever caused in in accessing or utilizing the Services; or

vii. any failure to provide the Services as a result of FH’s compliance with the Regulations.

  1. Fees and Charges

16.1 The Customer agrees to pay the fees and charges (if any) for the Services as per the FH's Schedule of Fees and Charges and as shown in the FH’s branches (at the time the relevant transaction is undertaken) or on FH website or as may be advised from time to time. FH may vary the applicable fees and charges, the frequency and dates of payment, introduce new fees or charges or adjusts any periodic transaction limits by giving a thirty (30) days’ notice by such method as FH shall decide.

16.2 If the revised fees and charges are not acceptable to the Customer then the Customer may cancel the Services in the manner provided in Clause 17 below (Termination) after settling all amounts outstanding.

16.3 The Customer authorizes FH to debit any of its Accounts with any pending fees and charges accrued in relation to the Services without any prior notification or consent of the Customer.

  1. Termination

17.1 The Customer may cease use of the FH Business App at any time upon written notice to FH;

17.2 FH may restrict the FH Business App anytime in its sole discretion for any reason whatsoever;

17.3 FH may terminate the FH Business App in the event that the Customer:

(a) fails to comply with these Terms & Conditions;

(b) fails to make any payment due in accordance with the Account, any financing facilities provided to the Customer by FH and these Terms & Conditions;

(c) engages in any illegal activity;

(d) is convicted of an offence under the laws of the UAE;

(e) ceases to be employed by his present employer;

(f) has an expulsion or deportation order issued against him/her; or

(g) files for bankruptcy.

17.4 FH shall use reasonable endeavours to notify the Customer of any termination.

17.5 Termination of the Account relationship will result in immediate and automatic termination of FH Business App.

17.6 Termination of the FH Business App shall not affect completion of any Instruction submitted prior to the effective date of termination of the Customer’s use of the FH Business App.

17.7 Termination of the FH Business App shall not affect the accrued rights and liabilities of the Customer prior to any such termination.

  1. Confidentiality

18.1 Each of the Customer and FH undertakes to the other to keep confidential all information communicated in any form concerning the business and affairs of the other that it shall obtain or receive prior to the entering into or during the performance of these Terms and Conditions. Each of the Customer and FH also undertakes to the other to not disclose, without the other's prior written consent, any confidential information, in whole or in part, to any other person save those of its employees involved in the implementation of these Terms and Conditions and who have a need to know and to use the information solely in connection with the implementation of these Terms and Conditions and not for its own or the benefit of any third party.

18.2 Notwithstanding anything to the contrary in these Terms and Conditions, FH may disclose and transfer any confidential information as required by law or regulation or requested by any competent authority.

18.3 The provisions of Clause 18.1 shall not apply to the whole or any part of the confidential information to the extent that it is already in the possession of the non-disclosing party or is already in the public domain through no negligence or misconduct of the non-disclosing party, is obtained from a third party, is or has been independently generated by the non-disclosing party or is property disclosed pursuant to applicable law or regulation.

  1. Notices

19.1 Any notice or other communication to be given in connection with any of the terms or provisions of these Terms and Conditions shall be in writing and in the English language and served by commercial courier service or facsimile to the address mentioned below and will be deemed effective as indicated:

19.1.1 if delivered by hand or courier service, on the date it is delivered; and

19.1.2 if sent by facsimile transmission, on the date it is transmitted as evidenced by the transmission report.

19.2 Where notice is given after 4:00 pm on a Business Day or on a day which is not a Business Day, the date of service shall be deemed to be the next Business Day.

19.3 Addresses for Notices:

19.3.2 All notices to the Customer shall be sent to the address set out in the Application, as amended from time to time by the Customer and notified to FH.

  1. Variation of the Terms

FH may, from time to time, and at its sole and absolute discretion, with prior notice by any means as FH deems fit, change, amend or supplement any of these Terms and Conditions or any other information it has issued about the Services at any time. Such variations shall apply on the effective date specified in the notification sent by FH to the Customer or when put up on the FH’s website as the case may be and if the Users continue to use the Services after such effective date, such variations will thereupon be binding on the Customer.

  1. General

21.1 FH's records maintained through the computer system or otherwise, unless proven to be wrong, shall be accepted as conclusive and legally binding evidence of the Customers Transactions using the FH Business App.

21.2 The Customer is responsible to ensure strict adherence to the security guidelines for the use of FH Business App. This includes ensuring that any other security alerts that are posted on FH's website and/or FH advised to the Customer through email are observed and complied at all times.

21.6 The Customer is fully aware and responsible to ensure strict adherence to the instructions and guidelines issued by FH from time to time on the use of FH Business App and that all authorized users and representatives of the Customer are fully trained and updated at all times on the terms of usage and handling of the FH Business App functionalities. This includes (without limitation) ensuring that all the authorized users and representatives of the Customer undergo adequate training in the use and handling of the FH Business App as prescribed by FH and reading and complying with all and any instructions and/ or guidelines provided to such authorized users and/or representatives from time to time through various medium made available by FH (including, but not limited to, any reference guides, e-mail, demo and help files).

  1. Governing Law & Jurisdiction

22.1 These Terms and Conditions shall be governed by and construed in accordance with the federal laws of the UAE as applied in the Emirate of Abu Dhabi and the laws of the Emirate of Abu Dhabi.

22.2 The parties agree to submit to the exclusive jurisdiction of the civil courts of the Emirate of Abu Dhabi provided that FH may, if it deems appropriate, bring proceedings in any other jurisdiction, inside or outside the UAE.

Product-wise Terms (e.g. Deposits, Rabeh Guarantee, etc) – There are existing T&C for various products. This shall be discussed in future.
